McDonald's Sued Over "Who's Your Patty" Ads

Lions Tap burgers in Minnesota has been using the tagline "Who's Your Patty?" for several years, registering the trademark four years ago.

Problem is, McDonald's has started to use the same phrase--"Who's Your Patty?" in their Angus Third Pounder burger ads.

So, Lions Tap is suing McDonald's on charges of trademark infringement, statutory unfair competition, false designation of origin and unjust enrichment, according to Nation's Restaurant News .

"McDonald's acts of infringement have caused Lions Tap damages, and Lions Tap seeks judgment for McDonald's profits made by McDonald's unauthorized and infringing use of Lions Tap's trademarks, for the damages sustained by Lions Tap, and for all costs necessary to remediate the infringing uses and their effects," the complaint says.
